民法典时代土地经营权租赁合同特殊性的立法实现

摘要:

现行立法调整土地经营权租赁关系以一般租赁合同规范为主要依据,忽视了农地的特殊性,在价值取向和合同内容等诸方面带来制度的不适应问题。本文首先分析了一般租赁规则调整土地经营权租赁合同时产生的矛盾冲突;其次,揭示了土地经营权租赁的特有原理;最后,运用规范分析、比较分析等方法,得出在《民法典》时代土地经营权租赁法律适用问题的解决路径。结论如下:①土地经营权租赁应选择在《民法典》之外专门立法的模式,通过修订《农业法》增加土地经营权租赁合同的特殊规定;②应专门规定租期调整、租金浮动机制、承租人改良权、禁止转租等内容。土地经营权租赁的特殊法律调整有利于以农地流转促进现代规模农业的形成。

Abstract:

According to the current legislation, the leasing of land management right is regulated by lease contract rules, which ignores the particularity of agricultural land, and creates institutional incompatibility in value orientation and contract contents. This article first analyzed the contradictions and conflicts when the general lease rules are applied to the leasing of land management right; It then revealed the unique characteristics of land management right lease; Finally, the methods of normative analysis and comparative analysis were adopted to identify solutions to the legal application problem in the era of Civil Code. The conclusions are as follows: Specialized legislative model apart from the Civil Code should be selected for the lease of land management right, and the special provisions should be added by amending the Agricultural Law; Special provisions include lease term adjustment, rent floating mechanism, lessees’ improvement right, prohibition of sublease, and so on. This special legal adjustment of land management right lease is conducive to promoting the formation of modern large-scale agriculture by means of agricultural land transfer.
